Zimbabwe Empowers Municipal Police with Arrest, Investigation, and Prosecution Powers

In a significant move to bolster local governance and enhance compliance with council regulations, Zimbabwe’s Cabinet has approved the Municipal Police and Courts Bill. This landmark legislation grants municipal police forces across the nation the authority to arrest, investigate, and prosecute by-law offenders, a responsibility previously limited to the national police.

Justice Minister Ziyambi Ziyambi presented the Municipal Police and Courts Bill, emphasizing its aim to empower city and town police to more effectively enforce local council rules. Historically, municipal police have been constrained, only able to issue tickets and required to hand over suspects to the Zimbabwe Republic Police (ZRP) for formal arrest and prosecution. This operational bottleneck has severely hampered efforts to address prevalent urban issues such as illegal vending, littering, public urination, and the proliferation of pirate taxis.

The proposed Bill, if enacted into law, will fundamentally transform the operational capabilities of municipal police by:

• Granting powers to arrest by-law violators: This will enable immediate action against offenders, reducing the reliance on national police intervention.

• Allowing them to investigate offences: Municipal police will be equipped to conduct their own inquiries into breaches of local ordinances.

• Enabling them to prosecute offenders through special municipal courts: The establishment of dedicated municipal courts will streamline the judicial process for minor infractions.

This legislative initiative builds upon existing frameworks that permit local councils to formulate their own by-laws. However, the effectiveness of these by-laws has been undermined by the municipal police’s lack of arresting powers. The new Bill seeks to rectify this long-standing enforcement gap.

A crucial component of the Bill is the provision for the creation of specialized municipal courts. These courts are designed to handle lower-level offences, such as littering and illegal trading, thereby alleviating the burden on mainstream courts, which can then focus on more serious criminal cases. This decentralization of justice for minor infractions is expected to improve efficiency and responsiveness at the local level.

Once the Municipal Police and Courts Bill is enacted, municipal police will gain operational autonomy, no longer needing to depend on the national police for the enforcement of council regulations. This is anticipated to lead to improved service delivery, fostering greater adherence to local by-laws, and ultimately contributing to better-managed and more orderly urban environments across Zimbabwe.
